
Entering the United States on a B-1/B-2 visitor visa and later requesting an extension of stay is common. The key is to file the request carefully to avoid falling out of status.
If you remain unlawfully present in the U.S. for more than 180 days, you may trigger a 3-year bar from re-entry. If unlawful presence reaches one year or more, the bar can become 10 years, and your visa may be canceled. To reduce risk, keep these points in mind before filing a visitor extension.
1) Explain why you need more time and why you will return home
USCIS must be convinced that your stay remains temporary. In your written statement, clearly explain the reason for the extension and why you will depart the U.S. once the additional time ends.
2) Include documents showing strong ties to your home country
Support your request with evidence that you maintain meaningful ties abroad, such as a lease or property records, vehicle registration, business documents, children’s school records, and similar proof that you intend to return.
3) Make sure translations are complete and properly certified
Translation issues can cause delays or denials. For Turkish documents, USCIS often expects complete translations. For example, Turkey’s “vukuatlı nüfus kayıt örneği” (detailed civil registration record) should be translated in full. If sections such as “comments/annotations” are omitted, it can create problems in the adjudication.
