One of our EB-5 clients from India had been waiting more than 17 months with no progress on their I-485. They filed both I-526 and I-485 in February 2024. The I-526 was approved in January 2025 but the green card applications stayed pending with no updates. They contacted our firm in July 2025. After reviewing the case we determined that a mandamus lawsuit was the right step. We filed the case on August 15 and in less than two months, on October 9, both the client and their spouse received green card approvals

Double Mandamus Success: From Asylum to Green Card in 17 Months

In December 2023, one of our clients contacted us after waiting more than 5 years for a decision on their asylum case. We reviewed the file and filed the first mandamus lawsuit right away.  Everything was resolved and the asylum was approved in April 2024, just a few months later. 

After that, our client filed for a Green Card (I-485) and a Refugee Travel Document (I-131) in May 2024. Both applications were pending for 17 months with no progress. When the wait reached a year and a half, the client contacted us again. After reviewing the case, we filed a second mandamus lawsuit on October 6, 2025, in the Eastern District of Virginia. A few weeks later, the Refugee Travel Document was approved. Soon after, the Green Card was approved as well
